Terms and conditions in app store

I'm trying to do music guessing app.I'm adding the songs inside the app myself (not using the songs in iPod). Is it illegal if i didn't ask permission from the music company?

    Yes is is. Music has to be licensed. BMI and ASCP will sue you.

    You need to go to the BMI or ASCP website and see about licensing fees and registration or come up with another game idea.

    What about photos? is it the same like songs? i mean photos of artistes

    Photos are copyrighted material too, you need to buy licenses. Try with old classic paints from masters that should be public domain and you can make a good guessing app with that. LOok at project guttemberg, there are many public domain books and illustrated stuff.
