You need to be an actual business and have documentation of being a business. You'll have to register a business in whatever area you live in and all that stuff. Its also not like getting a individual account on apples end, they take weeks to approve it and confirm your business.
Like @JohnPapiomitis said you have to actually be a business in order to use a business name. You first have to register as a business entity with your local authorities, it would most likely be a Ltd company here in the UK but will vary depending on where you're from. The process of establishing a business will give you certain documents proving the existence of the business, and this documentation is what you will need to send to Apple when you're setting up your developer account with them, so that you can prove to them that you do in fact own a business by that name.
I'm in the process of signing up with Mynameisace Limited and as @JohnPapiomitis said, you gotta have a real business and send in all your documentation.
Also, in the US you can't register with Apple as a business if you're a sole proprietor w/a registered name... has to be an LLC or Incorporated entity.
