is it legal to create a pokemon app

I know what ace says "if you cant tell if its legal or not dont do it" or something like that but I see a few pokemon apps still running after pokemon yellow was removed and Im wondering if its legal to make them because they do pretty well

    you could make something similar as long as its not called pokemon and the characters are not the same, then you will be fine.

    and you should probably menton that you dont own pokemon.

    Jackballs like the developer that published that Pokemon Yellow to the app store are going to end up jacking up the publishing/approval process for everyone. I think the next installment of Xcode should include an oversized steel-toed boot, so when you try to submit something like that it automatically kicks you where it counts.
