Putting off 'crop' on iPhone5

Hey all,

I have major problems fixing my iPhone 4 game for iPhone5, as you can read and see (printscreens included) in:

I have noticed that when on viewer, crop is not on, and just letterbox is on, the game is good viewable.
Is there any way to keep it on letterbox when on iPhone5 in stead of on crop?

    If you submit an app to apple with letterbox checked. Apple will reject it. If you have crop on. Apple with accept

    Why even give the option during publishing?

    Edit: If you are developing for iPhone 5 and you have letterbox on, how can apple reject you because of non-legacy support? Are you meaning iPhone 5 display with letterbox on?
